SCOTT D. MCKAY

Scott D. McKay is a civil litigation attorney and founding shareholder of the McKay Law Firm, P.A. The firm’s statewide practice includes real estate litigation, commercial and residential mortgage foreclosures, construction, association and judgment lien enforcement and foreclosures, commercial and residential evictions, collections of unsecured loans, factored obligations, over-drafted accounts, bad checks, credit cards, and other collection-related matters, banking and lending law and litigation and other general litigation. Additionally, Mr. McKay practices in the area of law commonly referred to as consumer protection law, prosecuting and providing counseling on class and mass actions in appropriate circumstances.

EDUCATION

Mr. McKay received his law degree from the University of Miami School of Law, where he graduated Cum Laude. While at the University of Miami School of Law, Mr. McKay was inducted into the Phi Delta Phi Legal Honor Fraternity. In addition, Mr. McKay was listed on the Dean’s List twice, was awarded the Dean’s Award for Academic Excellence with regard to his skills with Federal Jurisdiction and the Courts, as well as with regard to his skills with Commercial Law. Mr. McKay also received the CALI Excellence for the Future Award regarding his skills with Commercial Law.

Mr. McKay received his Bachelor of Arts from the University of Central Florida, where he also graduated Cum Laude. While at the University of Central Florida, in addition to other honors, Mr. McKay was inducted into the Golden Key Honor Society, was listed on the Presidents List, and appeared on the Dean’s List 6 times. Mr. McKay was also a Speech and Debate assistant instructor and was a Mediation Workshop instructor.

RELEVANT PUBLICATION, LECTURING AND WORK EXPERIENCE

Mr. McKay is an approved author and lecturer for Lorman Education Services, and currently lectures on the Fair Debt Collection Practices Act in different collection related seminars being offered by Lorman Education Services. Mr. McKay is heavily researched in Fair Debt Collection Practice Act law, and recently assembled a comprehensive Fair Debt Collection Practices Act manual for use in conjunction with the Lorman Education Services lectures.

When the rubber meets the road, Mr. McKay litigates the matters he lectures on. Mr. McKay set new law in both the Middle District of Florida Federal District Court, as well as the 11th Circuit Federal Appellate Court after prevailing at the trial and appellate level with regard to the Fair Debt Collection Practices Act in the published Vega case.

With regard to class actions, Mr. McKay has appeared and lectured at a class action seminar course offered by the University of Miami School of Law. Again demonstrating that Mr. McKay litigates the matters he lectures on, Mr. McKay previously worked at a class action law firm, where his practice focused on consumer protection law, generally consisting of complex litigation, class action and mass action representative matters.

MEMBERSHIP AND ADMISSIONS

Mr. McKay is admitted to practice law in both Florida and Minnesota. In Florida, Mr. McKay is also admitted to practice before all Federal District Courts, and is also admitted to practice before the 11th Circuit Federal Appellate Courts.
